Your rights in accordance with HB 4224

Texas House Bill 4224

Effective September 1st, 2025. In alignment with Health and Safety Code Section 181.105 and Texas House Bill 4224 (89th Regular Session),we are required to post details regarding how to:

a) contact the state's behavioral health executive council (BHEC),

b)filing a consumer complaint 

and c) requesting records from your mental health provider.

 

While The Reclaimed Collective, PLLC includes all of this information, and more, in client paperwork, posting this detailed information on our website complies with the new requirements in place.

Contacting the Behavioral Health Executive Council (BHEC)

Complaints + Business Violations

State Regulatory Board: You may file a complaint directly with BHEC via their Online Complaint Portal.

Texas Attorney General: You may also file a complaint with the Office of the Attorney General or by calling (800) 621-0508.

Records Request:

Requesting Mental Health Records

You have the right to request a copy of your mental health records. Records will be provided in accordance with Texas law and applicable privacy regulations. Records can be requested via email, in writing, or via your secure portal. Our full records release policy is in our Practice Policy paperwork, emailed out with your intake papers for SimplePractice. Please refer to that document for your policy in full. A release of information (ROI) must be completed for all requests.

Please note, under certain limited circumstances as listed in 45 CFR 164.524(a)(2) – (a)(3), we may deny access to all or a portion of your requested PHI.
